The paper examines the issue of determining limits courts’ jurisdiction in course consideration criminal cases related to smuggling, and presence procedural factors influencing determination territorial established by articles 32, 35 Code Criminal Procedure Russian Federation. considers practice Trans-Baikal Territory courts, reveals need for legislative resolution controversial issues determine smuggling. author makes proposals gives judgments on additional clarifications Supreme Court Federation rules applying Art. 32 It is smuggling that cause a certain difficulty establishing jurisdiction. due totality conditions these norms, given various places crimes committed, completion acts their severity.
